Some features are working, some are simulations and some are planned. We label which is which, and nothing here charges you.
The rules of working together.
The agreement for using Kubo — what you can expect from us, what we expect from you, and who owns what.
You own your workspace content and customer data. You’re responsible for having the right to use it and for telling your customers.
His answers can be wrong and are never professional advice, orders or commitments. Consequential actions always need confirmation.
Kubo™, the Kubo character and Swiid Technologies™ are ours. You may display Kubo through the widget; please don’t copy or alter him.
The summary is a guide only. The full text below is what applies.
Agreement to these terms
These terms of service (“terms”) are an agreement between you and Swiid Technologies (“Swiid Technologies,” “we,” “us” or “our”) about your use of Kubo — the Kubo website, public demo, dashboard, widget, APIs and documentation (together, the “Services”). Kubo is a product of, and is operated and powered by, Swiid Technologies.
By creating an account, installing the widget or otherwise using the Services, you agree to these terms and to our privacy policy. If you use the Services for a business or other organization, you agree on its behalf and confirm that you have authority to do so; “you” then means that organization.
If you don’t agree, please don’t use the Services.
What Kubo is today
Kubo is under active development and has not been publicly launched. We describe each capability honestly as working, simulation, partial or planned (see the current limitations). In particular, at the time of writing:
- answers come from grounded rules over approved records, and no generative AI model is connected;
- Live Assist is a local simulation that performs no upload, payment, order or paid generation;
- commerce connectors, scheduled report email, billing and voice are not connected; and
- no service level, uptime commitment or support response time is offered.
Features described as planned are forward-looking. They reflect current intentions only and are not promises that anything will be released or work in a particular way.
Accounts and eligibility
- You must be at least 18 and able to form a binding contract to create an account.
- Give accurate account and business information, and keep it up to date.
- Keep your password secret and use a strong, unique one. You are responsible for activity under your account; tell us at hello@swiidtech.com if you suspect unauthorized use.
- Workspace owners and admins control their workspace and its settings. You are responsible for the people you give access to and the roles they hold.
Your workspace and your customers’ data
You own it. As between you and us, you own your workspace content (business profile, knowledge, catalog, recorded events, brand settings, reports) and the data of your customers collected through Kubo (“Customer Data”).
Permission you give us. You grant us a limited, worldwide, non-exclusive licence to host, process, display and transmit that content only to provide, secure and support the Services for you, and as described in our privacy policy. We don’t use your data to serve other businesses or to train AI models.
Your responsibilities. Because you decide how Kubo is used with your customers, you are responsible for:
- having a lawful basis and any required consent to use Customer Data, and a privacy notice that tells your customers about Kubo;
- publishing only accurate information you have the right to share — Kubo will repeat your knowledge and catalog to customers;
- never placing secrets, private reports, personal data or confidential information in public knowledge, greetings or catalog fields;
- approving only website origins you own or control;
- keeping stock, prices and policies in Kubo up to date, since he answers from what you record; and
- responding to your customers’ privacy requests, with our help where needed.
Data processing. For Customer Data, we act as your processor and service provider: we process it only on your documented instructions (these terms and your settings), keep it confidential, protect it with appropriate security, help you respond to rights requests, tell you without undue delay about a personal data breach affecting it, and delete it when your account closes, as described in our privacy policy. A separate data processing agreement is available on request.
Acceptable use
You agree not to, and not to let anyone else:
- use the Services in violation of any law, or to deceive, defraud, harass, discriminate against or harm anyone;
- make Kubo present false, misleading or invented prices, availability, promotions, reviews or claims;
- publish fake ratings or reviews, or present paid placements as independent recommendations;
- collect sensitive personal information through Kubo without the protections the law requires;
- use Kubo for diagnosis, treatment, prescribing or clinical triage, or for personalized legal, financial or investment advice;
- direct Kubo at children without the notices and consents the law requires;
- probe, scan or test the Services’ security except as allowed in Security and responsible disclosure, or try to access another business’s data;
- attempt prompt injection, jailbreaking or other techniques to make Kubo act outside his permissions;
- overload, flood, scrape or reverse-engineer the Services, or circumvent rate limits and usage safeguards;
- embed the widget on a website you don’t control, or use the widget to impersonate another business; or
- resell, sublicense or offer the Services to third parties without our written agreement.
Kubo’s answers and automated assistance
Kubo is an automated assistant, not a person. His answers are generated from the records you provide and can be incomplete, out of date or wrong. They are general information only — never professional, medical, legal, financial or investment advice — and they do not create agreements, quotes, orders, bookings or commitments on your behalf or ours.
Business insights, such as Business Pulse findings, show counts, timeframes, sources and limitations. Customer questions are signals, not proof of demand or purchase intent. You are responsible for decisions you make based on them.
Consequential actions. Kubo is designed never to complete payments, purchases, orders, account or security changes, or other consequential actions without the appropriate authorization and explicit confirmation, and no model text can grant that authorization. Live Assist workflows only use controls and commands you register and approve.
Healthcare, financial services and other regulated uses
Healthcare. Kubo provides administrative assistance only — published service information, opening hours, approved appointment guidance and visitor navigation. It must not be used for diagnosis, prescribing, triage or clinical decisions, or with patient records. Healthcare conversation content is not stored. We make no claim that Kubo meets HIPAA or any other healthcare regulation, and we do not sign business associate agreements at this time.
Financial services and other regulated sectors. Use Kubo only for published information, and keep account data out of the public assistant. You are responsible for your own regulatory obligations. No certification or regulatory compliance is claimed.
Customer feedback and ratings
Kubo collects ratings and feedback only with the customer’s consent, and always lets them skip. You may not alter, invent or selectively delete genuine ratings to mislead people, or label feedback as a verified purchase unless a connected commerce source verifies it. If you publish Kubo feedback, you are responsible for complying with consumer protection and endorsement rules.
Plans, fees and usage safeguards
Plans shown on the pricing page are proposed. No prices are approved, checkout is not connected, and we will not charge you without your explicit agreement to a priced plan and these terms being updated to cover billing.
To prevent unexpected costs, the Services apply usage safeguards, such as a daily message limit per workspace. These are cost and abuse protections, not paid-plan entitlements, and we may adjust them.
Intellectual property, trademarks and the Kubo character
Our brands. Kubo™, the Kubo name and logo (including the two-eye mark), the Kubo character — his design, likeness, artwork, poses and expressions — and Swiid Technologies™ are trademarks and proprietary brand identifiers of Swiid Technologies.
Our Services. The software, website, documentation, designs, text, graphics, animations and other materials of the Services are owned by Swiid Technologies or its licensors and protected by applicable intellectual property laws. All rights not expressly granted are reserved.
Your licence to display Kubo. While your account is in good standing, we grant you a limited, non-exclusive, non-transferable, revocable licence to display the Kubo character on websites you control, only through the Kubo widget and the Brand Studio options we provide, to assist your customers.
What you may not do. You may not copy, extract, redraw, re-render, animate, modify, recolor or create derivative works of the Kubo character or artwork outside the Services; use Kubo or our marks in your own branding, products, merchandise or advertising; register confusingly similar names, domains or marks; or suggest that Swiid Technologies endorses you beyond your use of Kubo. Brand Studio customization never transfers ownership of the character.
Attribution. The widget may show “Kubo is a product of Swiid Technologies” or “Powered by Swiid Technologies.” Where a plan allows you to hide it, that does not change ownership.
Other people’s rights. Third-party names and marks mentioned in the Services belong to their owners, and mentioning them doesn’t imply endorsement. Press and partners who want to use our names or the Kubo character can ask at hello@swiidtech.com.
Your suggestions
If you send us ideas, suggestions or feedback about the Services, you give us permission to use them without restriction or payment. This doesn’t give us any rights in your workspace content or Customer Data.
Third-party services and links
The Services may link to or work with third-party websites and services. We don’t control them and aren’t responsible for their content, policies or availability. A connector or integration card is not a promise that an integration is working unless it is labeled as working.
Security and responsible disclosure
If you believe you’ve found a security vulnerability, please tell us privately at hello@swiidtech.com with “Security” in the subject, including enough detail to reproduce it. When researching, please:
- test only against your own account and workspace, and stop as soon as you confirm a problem;
- never access, change, copy or delete another business’s or customer’s information;
- avoid denial-of-service, spam, social engineering, physical attacks and heavy automated scanning; and
- give us reasonable time to fix the issue before sharing it publicly.
If you follow these guidelines, we won’t pursue legal action against you for your research. We don’t currently offer paid bug bounties.
Copyright complaints
If you believe content in the Services infringes your copyright, email hello@swiidtech.com with “Copyright notice” in the subject, including:
- your physical or electronic signature;
- a description of the work you believe has been infringed;
- where the material appears (for example, the URL or the business’s widget);
- your name, address, telephone number and email address;
- a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and
- a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act for them.
We review valid notices promptly and may remove or disable access to infringing material and terminate repeat infringers.
Changes and availability
We may change, suspend or discontinue any part of the Services, including features, limits and the demo, at any time. We don’t guarantee the Services will be available, uninterrupted, timely, secure or error-free. Where reasonably possible, we’ll give notice of changes that materially reduce what your workspace can do.
Suspension, termination and your data
You can stop using the Services and ask us to close your account at any time. We may suspend or end your access, or disable the widget, if we reasonably believe you have broken these terms or the law, or to protect the Services, other businesses, customers or Swiid Technologies.
When an account closes, we delete its workspace content and Customer Data as described in our privacy policy. Ask us before closing if you’d like an export. Sections that by their nature should continue — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive.
Disclaimers
The Services, including Kubo’s answers, insights and the demo, are provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory. To the fullest extent permitted by law, Swiid Technologies disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment.
We don’t warrant that Kubo’s answers or insights are complete, correct or current, or that the Services are free of errors or harmful components. You are responsible for how you use them.
Limitation of liability
To the extent permitted by law, Swiid Technologies and its owners, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Services or these terms, even if told such damages were possible.
To the extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these terms is limited to the amount you paid us for the Services in the 12 months before the event giving rise to the claim, or, if you paid nothing, one hundred U.S. dollars (US$100).
Nothing in these terms excludes or limits liability that can’t be excluded or limited by law, such as liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence, or rights you have as a consumer that can’t be waived.
Indemnification
If you use the Services for a business, you agree, to the extent permitted by law, to defend and indemnify Swiid Technologies and its owners, officers, employees, contractors and agents against third-party claims, and resulting damages, losses, costs and reasonable legal fees, to the extent the claim arises from:
- your workspace content or Customer Data, including information Kubo repeats to your customers;
- your unlawful use of the Services, or your failure to give your customers required notices or obtain required consents; or
- your material breach of these terms.
This applies only if we tell you promptly about the claim, let you control its defense and settlement, and cooperate reasonably at your expense. You don’t have to indemnify us to the extent a claim results from our own negligence, breach or violation of law.
Governing law and disputes
Swiid Technologies operates Kubo from New Castle, Delaware, USA. These terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Talk to us first. Before starting any formal proceeding, email hello@swiidtech.com describing the issue and the outcome you want, and give us 30 days to try to resolve it informally.
If we can’t resolve it, any dispute will be heard exclusively in the state courts located in New Castle County, Delaware, or the United States District Court for the District of Delaware, and you and we consent to the personal jurisdiction of those courts. Either party may seek urgent relief in any court with jurisdiction to protect its intellectual property or confidential information. If you are a consumer, nothing here removes the protection of mandatory consumer laws where you live.
Export controls and sanctions
You agree to comply with applicable export control and sanctions laws, including those of the United States. You may not use the Services if you are located in, or are a resident or national of, a country or region subject to comprehensive U.S. sanctions, or appear on a U.S. government list of restricted parties.
General terms
- Entire agreement. These terms and our privacy policy are the entire agreement about the Services, unless we sign a separate written agreement with you, which then controls for what it covers.
- Severability. If any part is unenforceable, it is limited only as much as needed and the rest stays in effect.
- No waiver. Not enforcing a right doesn’t waive it.
- Assignment. You may not transfer these terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets.
- Events outside our control. We aren’t responsible for delays or failures caused by events beyond our reasonable control.
- Electronic communications. Electronic notices satisfy any requirement that they be in writing.
- No third-party rights. These terms give no rights to anyone other than you and us.
- Language. These terms are written in English, which controls over any translation.
Changes to these terms
We may update these terms. We’ll post the new version here, change the “Last updated” date and, for significant changes — such as introducing billing — give prominent notice before they apply. Continuing to use the Services after changes take effect means you accept them.
